Terms of Service

These terms govern your use of the Quizat (quizat.io) platform, owned and operated by the Quizat team, Kuwait. By using the platform or creating an account, you acknowledge that you:

• Are at least 18 years old, or the age of legal majority in your country, whichever is higher.
• Have full legal capacity to enter into binding contracts.
• Have read and understood these terms and agree to be bound by them.

If you are using the platform on behalf of an institution or educational organization, you acknowledge that you have the legal authority to bind that organization to these terms and accept responsibility both personally and on its behalf.

Quizat is an AI-powered educational platform that converts lecture files (PDF and PowerPoint) into interactive quizzes and personalized flashcards for university students. The service includes:

• Generating multiple-choice and true/false questions from uploaded slides.
• Creating educational flashcards from uploaded content.
• Organizing content into courses and tracking results and study history.
• Sharing quizzes via public links.
• Free and paid subscription plans with different generation tiers.

Important notice: the platform relies on external AI models (Anthropic Claude) to process and generate content. The accuracy of generated content is not fully guaranteed and should always be verified against reliable academic sources.

We reserve the right to modify, update, reduce the features of, or discontinue the service in whole or in part at any time, while making reasonable efforts to provide advance notice. We will not be liable for any loss resulting from service interruption or modification.

By registering an account with Quizat, you agree to:

• Provide accurate, correct, and complete information, and update it promptly when it changes.
• Keep your login credentials (email and password) confidential.
• Notify us immediately at support@quizat.io if you suspect any unauthorized access to your account.
• Not share your account with anyone else — each account is intended for a single user only.

You are solely responsible for all activity that occurs through your account, whether carried out by you or someone else due to your failure to protect your credentials. Quizat is not responsible for any losses resulting from unauthorized access to your account.

Quizat offers the following plans:

• Free: a limited number of monthly generations at no cost.
• Student and Pro: paid plans with higher generation limits, billed monthly and renewed automatically.

All payments are processed via Stripe, a globally certified payment provider compliant with PCI DSS Level 1 standards. Your credit card details are never stored on our systems.

Paid subscriptions renew automatically at the end of each monthly cycle until the user explicitly cancels from the billing page. Cancellation stops the next renewal and does not end the current period.

We reserve the right to adjust plan pricing with at least 30 days advance notice. Continuing your subscription after the change takes effect constitutes acceptance of the new pricing.

You agree to use Quizat exclusively for legitimate educational purposes, and you agree not to:

• Upload files protected by intellectual property rights without explicit permission from the rights holders.
• Upload content containing harmful, explicit, illegal, abusive, or discriminatory material.
• Use the platform in any way that contributes to cheating or violates academic integrity policies at your institution — this is your sole responsibility, and Quizat bears no liability for it.
• Attempt to bypass quota limits, rate limiting controls, or any other technical restrictions.
• Use bots, automation, or any non-human means to access the service or generate content.
• Resell, redistribute, or commercially license the service to any third party.
• Scrape data or reverse-engineer any part of the platform or its infrastructure.
• Conduct penetration testing or security assessments on the platform without prior written permission.
• Violate any local or international law applicable in your country or in Kuwait.

We reserve the right to suspend or terminate any account suspected of violating these provisions, without prior notice and without any refund obligation.

When you upload a file, you represent and warrant that you own the rights necessary to upload and process it, or that you have explicit permission from the rights holders to do so. You alone are responsible for any intellectual property infringement arising from the files you upload.

AI file processing: uploaded files are sent to Anthropic (the company that develops the Claude AI model) for processing and generating educational content. By using the platform and uploading files, you explicitly agree to this external processing and acknowledge that Anthropic will have access to your file's content per its terms of service and privacy policy. Per Anthropic's stated policy, API data is not used to train its models by default.

Immediate deletion: uploaded files are deleted from our storage as soon as the generation process completes or fails. We do not retain your academic files on our servers after processing is complete.

Accuracy of generated content: the questions and flashcards created are produced by an AI model and may contain errors, incomplete information, or inaccurate interpretations. Do not rely on them exclusively for studying — always cross-check with your original academic sources (textbooks, lectures, faculty members). Quizat bears no responsibility whatsoever for any academic consequences resulting from reliance on this content.

Your ownership: the files you upload belong to you or their rights holders. By uploading them, you grant us a limited, non-exclusive, and temporary license to process them only to the extent necessary to provide the service, and this license terminates immediately upon deletion of the file.

Generated content: quizzes and flashcards generated from your files belong to you, subject to the rights of the original file owners. By saving this content on the platform, you grant us a license to store it for as long as your account remains active.

Public sharing: when you share a quiz via a public link, you bear full legal responsibility for the nature of the shared content and any intellectual property infringement that may arise from this sharing.

Quizat's ownership: the platform, its design, source code, trademarks, algorithms, and all original content belong exclusively to Quizat and are protected by intellectual property laws. Using the platform grants you no rights to this property.

Intellectual property infringement reports: if you believe content on the platform infringes your rights, contact us at support@quizat.io with details of the infringing content, proof of your ownership, and your contact information, and we will handle the report seriously and as promptly as possible.

The service is provided "AS IS" and "AS AVAILABLE" without any express or implied warranties, including but not limited to:

• Implied warranties of fitness for a particular purpose or merchantability.
• A guarantee of the academic or scientific accuracy of AI-generated content.
• A guarantee of continuous availability or freedom from outages or software errors.
• A guarantee of achieving specific academic or study results.
• A guarantee that the service will be free of effects from third-party outages (Anthropic, Supabase, Vercel).

We rely on external service providers to operate the platform. Any interruption to their services may affect Quizat's availability in ways beyond our control, and we are not liable for these interruptions.

To the maximum extent permitted by applicable law, Quizat, its directors, employees, partners, or suppliers shall not be liable in any case for:

• Any indirect, consequential, incidental, punitive, or special damages of any kind.
• Loss of data, profits, educational opportunities, or academic reputation.
• Any academic consequences such as failing grades, exam failures, or institutional penalties.
• Errors, omissions, or misleading information in AI-generated content.
• Service downtime, interruptions, or loss of access to stored content.
• Users' infringement of intellectual property rights or academic integrity laws.
• Any claim arising from content uploaded or shared by a user.
• Security breaches beyond our reasonable control.

In all cases, Quizat's total maximum liability to you is limited to the total amount you actually paid to Quizat during the three months immediately preceding the incident, or the equivalent of five Kuwaiti dinars (KD 5), whichever is greater, even if we have been advised of the possibility of such damages.

You agree to indemnify Quizat and hold harmless its directors, employees, and partners from any claims, lawsuits, legal costs, or losses arising from:

• Your violation of these terms or any applicable law in your country or in Kuwait.
• Files and content you upload or share via the platform.
• Your infringement of any third party's intellectual property rights.
• Your violation of academic integrity policies at your educational institution.
• Any harm you cause to other users or third parties through your use of the platform.
• Any false or misleading statements you made during registration or use.

By the user: you may close your account at any time from your profile page or by contacting us. No refund is due upon closure, per Section 5.

By Quizat: we reserve the right to suspend or terminate your account — with or without notice — in the following cases:

• Violation of these terms or any of our policies.
• Uploading illegal content or content that infringes the rights of others.
• Suspected fraud, system manipulation, or attempted exploitation of vulnerabilities.
• Failure to pay outstanding subscription fees.
• Any reason we deem necessary to protect the platform, its users, or service integrity.

Effect of termination: your access to the platform ends immediately. Content associated with your account may be deleted. The following provisions survive termination: disclaimers, limitation of liability, indemnification, and governing law.

Quizat relies on external service providers to operate the platform. Your use of the platform means you agree to these providers handling your data per their own terms. We are not responsible for their practices:

• Anthropic — AI processing and content generation.
• Supabase — databases, authentication, and storage (United States, SOC 2 certified).
• Stripe — payment processing (PCI DSS Level 1 certified).
• Sentry — error and performance monitoring.
• Vercel — hosting and infrastructure.

We reserve the right to modify these terms at any time. For material changes, we will notify you via email or a prominent in-app notice at least 14 days before the change takes effect. Your continued use of the platform after that date constitutes explicit acceptance of the modified terms.

If you do not agree to the changes, you may close your account before they take effect, subject to the no-refund policy described in Section 5.

These terms are governed by and construed in accordance with the laws of the State of Kuwait, and the competent Kuwaiti courts shall have exclusive jurisdiction over any dispute arising from them, without regard to conflict-of-law rules.

Before resorting to litigation, we encourage you to contact us directly at support@quizat.io to attempt an amicable resolution of the dispute within 30 days of notifying us.

Entire agreement: these terms, together with the privacy policy, constitute the entire agreement between you and Quizat and supersede any prior agreements or understandings.

Severability: if any provision of these terms is found to be legally unenforceable, the remaining terms shall remain in full force and effect.

No waiver: our failure to enforce any provision shall not be deemed a waiver of our right to enforce it in the future.
